Eklo Terms of Service (0.9 private beta)
Last updated
These terms govern a church's use of Eklo during the 0.9 private beta, which is invitation-only. Effective date: November 3, 2026.
1. Who these terms cover
Agreement. These Terms of Service ("Terms") are an agreement between Mind Mill Media, LLC, PO Box 2922, Cleveland, TN 37320 ("Eklo", "we", "us") and the church or organization that uses Eklo ("Customer", "you"). The person who accepts them confirms they can bind that organization.
Users. People the Customer invites into its workspace (staff, volunteers, members and guests) use Eklo under the Customer's account. They must follow section 6. The Customer is responsible for their use.
2. The private beta
Eklo 0.9 is a pre-release version. We choose which churches join, and we may limit numbers or features. The beta is for tax-exempt churches and ministries, and it needs a paid plan (section 7).
- Features may change, stop working or be removed without notice.
- The service may be unavailable at times, including for maintenance and migrations.
- We may end the beta, or your place in it, as described in section 9.
- If you send us feedback or ideas, we may use them to improve Eklo with no obligation to you.
3. Eligibility and accounts
You must be at least 18 to create a workspace or accept these Terms for a Customer. Eklo is not directed at children under 13, and children under 13 may not create accounts.
Eklo has no passwords. Users sign in with a six-digit code or a sign-in link sent by email; codes expire after 5 minutes and links after 10. Where enabled, users can also sign in with Google or a passkey. SAML single sign-on through the Customer's own identity provider is available during the beta; after it, SAML is included on the plans that list it at eklo.io/pricing.
You are responsible for:
- keeping access to the email accounts your users sign in with secure;
- who you invite, the roles you give them, and what guests can see;
- all activity in your workspace; and
- telling us promptly at hello@eklo.io if you suspect unauthorized access.
4. Your content and our roles
Customer Data is everything you and your users put into Eklo: forms and submissions, tasks and comments, chat and direct messages, files and Library media, member and email-audience lists, conversations with Ask Eklo, the AI assistant, and the notes it keeps and images it makes, and the personal data inside them.
Ownership. You own Customer Data. You give Eklo a limited right to host, copy, process, send and display it only to provide, secure and support the service, and as you instruct.
Roles. For Customer Data, you are the controller and Eklo is your processor (a "service provider" under US state privacy laws). The Data Processing Addendum forms part of these Terms. For account data, beta-request data and data from our marketing site, Eklo is the controller, as the Privacy Policy explains.
Your responsibilities for Customer Data. You decide what personal data to collect through Eklo, and you are responsible for:
- having a lawful basis, and giving any notices and getting any consents the law requires;
- data that reveals religious belief or health (for example membership, attendance or prayer requests), which many laws treat as sensitive;
- information about children that parents, guardians or your staff enter, including any parental consent the law requires; and
- honoring requests from people whose data you hold, with our help as set out in the DPA.
5. AI features
Eklo includes AI features:
- Ask Eklo, an AI assistant that, inside Eklo, works only with what the person asking can open. It can search your workspace's tasks, chat channels, people, teams and forms, list the requests that person sent or must decide, read files attached to it, search the web, make images, remember notes for that person, and remind them of things later. It can also create and change tasks and forms, post messages and comments, create channels and teams, add people to teams, send requests by filling in forms, and approve or decline requests waiting on that person. It asks that person to confirm anything that would notify someone else, and what it does is done in their name, with nothing marking it as written by AI; and
- image tagging for Library images, once the Library is available (it isn't during the beta).
AI edit requests for Library images are not sent to an AI provider; Eklo saves each request as a note on a new version for your team to review.
To provide these, the text, files, images and workspace content involved are sent to our AI subprocessors (OpenAI and Anthropic), and Anthropic runs Ask Eklo's web searches. Both providers' business terms say they do not train their models on this data by default. When enabled, a sample of Ask Eklo requests is also traced with Braintrust so we can monitor how AI features perform; traces record sizes and token counts, not content. Workspace owners and admins can turn AI features off in Settings → General, and while they're off no request from that workspace is sent to an AI provider, apart from the rest of any answer Ask Eklo was already writing when they were turned off. The Subprocessors list gives details.
AI output can be wrong or incomplete. Review it before you rely on it, and don't use it as the only basis for decisions about people.
6. Acceptable use
You and your users must not use Eklo to:
- break the law or infringe anyone's rights, including privacy and intellectual property;
- harass, threaten or abuse anyone, or share sexual content involving minors;
- collect payment card numbers, bank details, government ID numbers or passwords through forms;
- upload malware, or probe, scan or attack Eklo or other users;
- get around access controls, rate limits or bot checks, or try to reach another workspace's data;
- copy, resell or reverse-engineer Eklo, except where the law allows it; or
- overload the service or interfere with other customers.
We may remove content or restrict features that break these rules.
7. Fees
Plans. Our plans and prices are published at eklo.io/pricing. A church joining the beta needs a paid plan. When the workspace owner sets up the workspace, they choose a plan, billed monthly or yearly, and accept these Terms for the Customer.
Billing and renewal. Paid plans are billed in advance through Stripe, our payment processor. Payment details go straight to Stripe; Eklo doesn't receive or store card numbers. A plan renews automatically at the end of each billing period, for another period of the same length, until it is cancelled. The workspace owner can update payment details, see invoices or cancel from Settings → Billing, which opens Stripe's billing portal. A cancellation takes effect at the end of the period already paid for. Fees already paid are not refunded, except where the law requires it.
Price changes. We may change our prices. We will tell the workspace owner at least 30 days before a new price applies to your next renewal, and you can cancel before then.
Taxes. Prices don't include sales tax or similar taxes. We add any tax that applies where your church is billed, unless we have verified a valid exemption for the Customer. The beta is for tax-exempt churches and ministries: the workspace owner confirms that the Customer is tax-exempt and uploads proof, such as an IRS determination letter or a state sales-tax exemption certificate. We review the proof, and invoices issued before we verify it may include tax. You must tell us promptly if the Customer's exemption ends or changes, and you are responsible for any tax, interest or penalties that result from inaccurate exemption information.
Complimentary plans. We may, at our discretion, cover the fees for a Customer's plan. We will give the workspace owner at least 30 days' notice before we stop covering them. After that the plan renews at its published price unless you cancel.
Late payment. If a payment fails, Stripe retries it and we let the workspace owner know. If fees stay unpaid, we may suspend the workspace as described in section 9.
8. Beta terms: provided "as is"
Because Eklo is in beta, it is provided "as is" and "as available". To the extent the law allows, we make no warranties, express or implied, including fitness for a particular purpose, merchantability, non-infringement, or that the service will be uninterrupted, error-free or secure. Keep your own copies of anything you can't afford to lose.
9. Suspension and termination
You can stop using Eklo at any time. Workspace owners and admins can export the workspace's main data from Settings → Data: people, teams, campuses, projects, tasks and comments, forms, submissions and approvals, channel messages, custom fields, workflows and uploaded files. The export doesn't include direct messages, Ask Eklo's conversations, files, images, notes or reminders, task templates, questions asked of form submitters, activity history or email audiences; email hello@eklo.io for a copy of anything else. The owner can delete the workspace there. A deleted workspace can be restored for 30 days and is then permanently deleted. Anyone can delete their own account from Settings → Profile. For anything else, email hello@eklo.io.
We may suspend or end your access:
- immediately, if you breach these Terms, create a security or legal risk, or the law requires it; or
- with at least 30 days' notice where practical, if we end the beta or stop offering Eklo.
If we end your access for a reason other than your breach, we refund any fees you paid for the part of the billing period after it ends.
After termination, we delete Customer Data as the DPA describes. Sections 4 (ownership), 8, 10, 11, 12 and 13 survive.
10. Limitation of liability
To the extent the law allows:
- neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data; and
- each party's total liability under these Terms is limited to the greater of the amounts you paid Eklo in the 12 months before the claim and USD 500.
These limits don't apply to your obligations under section 11, or where the law doesn't allow them.
11. Your responsibility for Customer Data
You will defend and indemnify Eklo against third-party claims arising from Customer Data or from your use of Eklo in breach of these Terms or the law, including collecting personal data without a lawful basis.
12. Governing law
These Terms are governed by the laws of the State of Tennessee. Disputes go to the state courts in Bradley County, Tennessee, or the federal courts for the Eastern District of Tennessee, unless the law where you are based requires otherwise.
13. Changes, notices and contact
We may update these Terms. For material changes we will give at least 30 days' notice by email or in the app. If you keep using Eklo after a change takes effect, the new Terms apply.
We send notices to the email address of your workspace's owner. Contact us at hello@eklo.io or Mind Mill Media, LLC, PO Box 2922, Cleveland, TN 37320.
